Designation of Perfluorooctanoic Acid (PFOA) and Perfluorooctanesulfonic Acid (PFOS) as CERCLA Hazardous Substances

Pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act ("CERCLA" or "Superfund"), the Environmental Protection Agency (EPA) is designating two per- and polyfluoroalkyl substances (PFAS)--perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), including their salts and structural isomers--as hazardous substances.

Air Plan Approval; New Hampshire; Reasonable Available Control Technology for the 2008 and 2015 Ozone Standards

The Environmental Protection Agency (EPA) is approving State Implementation Plan (SIP) revisions submitted by the State of New Hampshire. The revisions establish NO<INF>X</INF> reasonably available control technology (RACT) requirements for coal-fired cyclone boilers located in the state, portions of New Hampshire's NO<INF>X</INF> RACT certifications for the 2008 and 2015 ozone standards that pertain to requirements for coal-fired cyclone boilers, and withdrawal from the SIP of two previously issued RACT orders.

Air Plan Approval; Indiana; Opacity Rule

The Environmental Protection Agency (EPA) is approving a revision to the Indiana State Implementation Plan (SIP), authorizing temporary alternative opacity limitations at the BP Products North America, Inc. (BP) facility in Whiting, Indiana during startup and shutdown. This approval is consistent with the Clean Air Act (CAA) and EPA regulations regarding emissions during these periods in the refinery sector. EPA proposed to approve this SIP submission on August 17, 2022, and received no comments.

Air Plan Approval; KY; Updates to Attainment Status Designations

The Commonwealth of Kentucky, through the Kentucky Energy and Environment Cabinet (Cabinet), Kentucky Division for Air Quality (KDAQ), submitted a revision to the Kentucky State Implementation Plan (SIP) on November 29, 2022. The SIP revision updates the geographical boundary description and attainment status designation for the Henderson-Webster nonattainment area for the 2010 Sulfur Dioxide (SO<INF>2</INF>) primary National Ambient Air Quality Standards (NAAQS).

The Environmental Protection Agency (EPA) is taking final action to approve state implementation plan (SIP) revisions to the Yolo-Solano Air Quality Management District (YSAQMD) portion of the California SIP. These revisions concern emissions of oxides of nitrogen (NO<INF>X</INF>) from biomass boilers, and address reasonably available control technology (RACT) requirements for major sources of NO<INF>X</INF> in the portion of the Sacramento Metro, CA, nonattainment area that is subject to YSAQMD jurisdiction.
