Finding of Failure To Submit a Clean Air Act Section 110 State Implementation Plan for Interstate Transport for the 2015 Ozone National Ambient Air Quality Standards (NAAQS)

The Environmental Protection Agency (EPA) is taking final action, finding that the State of Alabama failed to submit a complete infrastructure State Implementation Plan (SIP) revision to satisfy certain interstate transport requirements of the Clean Air Act (CAA or Act) with respect to the 2015 8-hour ozone national ambient air quality standards (NAAQS). Specifically, these requirements pertain to prohibiting significant contribution to nonattainment, or interference with maintenance, of the 2015 8-hour ozone NAAQS in other states.

Air Plan Approval; North Carolina; North Carolina BART Rule Revisions

The Environmental Protection Agency (EPA) is finalizing approval of a North Carolina State Implementation Plan (SIP) revision, submitted through a letter dated April 13, 2021. The SIP revision includes changes to North Carolina's SIP-approved rule addressing best available retrofit technology (BART) for regional haze. EPA is approving North Carolina's SIP revision because the changes are consistent with Clean Air Act (CAA or Act) requirements.

Air Plan Approval; Iowa; State Implementation Plan and State Operating Permits Program

The Environmental Protection Agency (EPA) is proposing to approve revisions to the Iowa State Implementation Plan (SIP) and the Iowa Operating Permit Program. The revisions update incorporations by reference to EPA methods for measuring air pollutant emissions, performance testing (stack testing) and continuous monitoring. These revisions do not impact the stringency of the SIP or have an adverse effect on air quality. The EPA's proposed approval of this rule revision is being done in accordance with the requirements of the Clean Air Act (CAA).

Air Plan Disapproval; California; Antelope Valley Air Quality Management District and Mojave Desert Air Quality Management District

The Environmental Protection Agency (EPA) is proposing to disapprove revisions to the Antelope Valley Air Quality Management District (AVAQMD) and the Mojave Desert Air Quality Management District (MDAQMD) portions of the California State Implementation Plan (SIP) concerning rules submitted to address section 185 of the Clean Air Act (CAA or the Act) with respect to the 1-hour ozone standard. We are proposing action on these local rules that were submitted as equivalent alternatives to a statutory section 185 program.

Air Plan Approval; California; San Joaquin Valley Unified Air Pollution Control District; Open Burning

The Environmental Protection Agency (EPA) is taking final action to approve a revision to the San Joaquin Valley Unified Air Pollution Control District (SJVUAPCD or the ``District'') portion of the California State Implementation Plan (SIP). This revision concerns emissions of oxides of nitrogen (NO<INF>X</INF>) and particulate matter (PM) from agricultural open burning. We are approving additional local restrictions on such burning under the Clean Air Act (CAA or the Act).

Approval and Promulgation of Implementation Plans; New York; Oil and Natural Gas Control Measures

The Environmental Protection Agency (EPA) is proposing to approve a State Implementation Plan (SIP) revision submitted by the state of New York. The revision provides the State's control measures for facilities within its borders subject to EPA's 2016 Control Techniques Guideline (CTG) for the oil and natural gas industry. The intended effect of this action is to approve this item into the New York SIP and satisfy the requirement for the CTG. This action is being taken in accordance with the requirements of the Clean Air Act (CAA).

Air Plan Approval; Missouri; General Conformity Rescission

The Environmental Protection Agency (EPA) is proposing to approve a revision to the Missouri State Implementation Plan (SIP) relating to General Conformity received on April 15, 2022. In its submission, Missouri requests EPA approval of rescission of the Missouri General Conformity Rule from the Missouri SIP. General Conformity ensures actions taken by federal agencies, such as airport construction, do not interfere with a state's plans to attain and maintain national standards for air quality.

Clean Air Plans; Base Year Emissions Inventories for the 2015 Ozone Standards; Nevada; Clark County, Las Vegas Valley

The Environmental Protection Agency (EPA) is proposing to approve, under the Clean Air Act (CAA or ``Act''), revisions to the Nevada State Implementation Plan (SIP) concerning the base year emissions inventory requirements for the Las Vegas Valley ozone nonattainment area located within Clark County for the 2015 ozone national ambient air quality standards (NAAQS or ``standards'').

Air Plan Approval; Albuquerque-Bernalillo County, New Mexico; Excess Emissions

Pursuant to the Federal Clean Air Act (CAA, the Act), the Environmental Protection Agency (EPA) is proposing to approve a State Implementation Plan (SIP) revision from the New Mexico Environment Department (NMED) submitted on October 17, 2016, on behalf of the Albuquerque-Bernalillo County Air Quality Control Board (Air Board). The October 17, 2016 submittal is in response to the EPA's national SIP call on June 12, 2015, concerning excess emissions during periods of Startup, Shutdown, and Malfunction (SSM).

Approval and Promulgation of Air Quality Implementation Plans; Delaware; Removal of Stage II Gasoline Vapor Recovery Program Requirements and Revision of Stage I Gasoline Vapor Recovery Program Requirements

The Environmental Protection Agency (EPA) is approving a state implementation plan (SIP) revision, made in two separate submittals, by the State of Delaware. This revision removes requirements for gasoline vapor recovery systems installed on gasoline dispensers, the purpose of which are to capture emissions from vehicle refueling operations, otherwise known as Stage II vapor recovery. This revision also strengthens Delaware's requirements for gasoline vapor recovery systems that capture emissions from storage tank refueling operations, otherwise known as Stage I vapor recovery.
